Tejori – Terms and conditions

1. DEFINITIONS
- “Buyer” means a user who purchases an item via the Platform.
- “Seller” means a user who lists and sells items via the Platform.
- “User” means any individual or business accessing or using the Platform.
- “Listing” means an item offered for sale on the Platform.
-“Services” means the marketplace services, payment facilitation, content, and features provided by Tejori.
2. MARKETPLACE ROLE & SCOPE
- Tejori provides an online marketplace and intermediary services in accordance with the Electronic Commerce (EC Directive) Regulations 2002.
- Except where Tejori is expressly identified as the seller, Tejori is not a party to contracts between Buyers and Sellers.
- Contracts for sale are formed directly between Buyers and Sellers.
- Tejori does not guarantee the quality, safety, authenticity, legality, or accuracy of Listings.
3. ELIGIBILITY & ACCOUNT REGISTRATION
- You must be at least 18 years old to use the Platform.
- You agree to provide accurate, current, and complete information when creating an account.
- You are responsible for safeguarding your login credentials and all activity on your account.
- We reserve the right to suspend or terminate accounts that:
- Provide false or misleading information;
- Engage in fraudulent, abusive, or unlawful conduct; or
- Breach these Terms.
4. SELLER OBLIGATIONS
Sellers agree that they:
- Have legal ownership and the right to sell listed items.
- Accurately describe items, including condition (e.g. pre-loved, new with tags, outlet stock).
- Comply with all applicable consumer, tax, customs, and product safety laws.
- Dispatch items within stated timeframes.
- Do not list prohibited, counterfeit, stolen, or unsafe goods.
Tejori reserves the right to remove Listings that breach these Terms or applicable laws.
5. BUYER OBLIGATIONS
Buyers agree that they:
- Review listings carefully before purchasing.
- Enter into legally binding contracts when placing orders.
- Provide accurate delivery and payment information.
6. PRICING, FEES & PAYMENTS
- Prices are set by Sellers unless otherwise stated.
- Payments are processed through approved third-party payment providers.
- Tejori does not store full payment card details.
- We accept card payments – accepting all major credit and debit cards (Visa, Mastercard, American Express, etc.).
7. DELIVERY AND SALES
- Sellers are responsible for dispatching items and providing accurate delivery information.
- Buyers are responsible for any customs duties, import taxes, or fees applicable to orders.
- Tejori is not responsible for delays caused by couriers or any unforeseeable circumstances or events.
8. RETURNS, REFUNDS, PAYMENT HOLDING & DISPUTES
8.1 Payment Holding & Release
- Tejori operates a payment holding (escrow-style) mechanism. Buyer payments are held by the Platform and are only released to the Seller once the item has been marked as received by the Buyer.
- Sellers must dispatch items within 7 working days of the sale unless otherwise agreed with the Buyer.
- If an item is not dispatched within 7 working days, the Buyer may cancel the order and receive a full refund.
- Once an item is marked as received, funds will be released to the Seller.
- If the Buyer does not mark the item as received or raise a dispute within 5 working days of confirmed delivery, the funds will be automatically released to the Seller.
8.2 Returns & Refunds
- As a peer-to-peer marketplace, Tejori does not offer discretionary returns or refunds.
- Refunds will only be considered where:
- The item was not dispatched within the required timeframe;
- The item received is significantly not as described; or
- The item arrives damaged.
- Where the Seller is acting in the course of business, Buyers may have additional statutory rights under UK consumer law which cannot be excluded.
8.3 Disputes
- Buyers must raise any disputes within 5 working days of receiving the item.
- Disputes raised after this period may not be eligible for review.
- All disputes will be reviewed by Tejori based on evidence provided by both parties, including photographs, descriptions, and delivery confirmation.
- Only disputes eligible for a refund under these Terms will be reviewed.
8.4 Seller Responsibility
Sellers are strongly encouraged to provide accurate, honest, and complete descriptions of Listings, including condition and defects, and to retain proof of postage and a valid tracking number for all dispatched items. Failure to do so may result in refunds being issued, non-release of funds, account action, or removal from the Platform.
9. Consumer Rights
Nothing in these Terms limits your statutory rights under applicable UK consumer protection laws, including the Consumer Rights Act 2015, Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and Consumer Protection from Unfair Trading Regulations 2008. These rights apply particularly where a Seller is acting in the course of business.
10. Intellectual Property
- All Platform content, branding, software, and trademarks belong to Tejori or its licensors.
- Users grant Tejori a worldwide, non‑exclusive, royalty‑free licence to use content they upload for Platform operation and marketing.
- You may not copy, reproduce, or exploit Platform content without permission.
11. Prohibited Conduct
You must not:
- Use the Platform for unlawful or misleading purposes;
- Upload false, defamatory, or infringing content;
- Attempt to bypass Platform fees or systems;
- Engage in scraping, hacking, or reverse engineering.
12. Limitation of Liability
- Tejori is not liable for losses arising from transactions between Users.
- To the maximum extent permitted by law, Tejori excludes liability for indirect or consequential losses.
- Where liability cannot be excluded, it shall be limited to fees paid to Tejori in the preceding 12 months.
Nothing excludes liability for death or personal injury caused by negligence or fraud.
13. Indemnity
Nothing in these Terms limits your statutory rights under applicable UK consumer protection laws, including the Consumer Rights Act 2015, Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and Consumer Protection from Unfair Trading Regulations 2008. These rights apply particularly where a Seller is acting in the course of business.
14. Suspension & Termination
We may suspend or terminate access to the Platform at any time where you breach these Terms or pose legal or reputational risk.
15. Privacy & Data Protection
Your use of the Platform is governed by our Privacy Policy, which complies with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
16. Changes to These Terms
We may update these Terms from time to time. Continued use of the Platform after changes are posted constitutes acceptance.
17. Governing Law & Jurisdiction
These Terms are governed by the laws of England and Wales. Where you are a consumer, you may bring proceedings in the courts of the part of the UK in which you live. Otherwise, the courts of England and Wales shall have exclusive jurisdiction.
